Bad journalism?

The IDF answers:

1. The new military order was signed 6 months ago.

2. There are no changes to the repatriation system or the authority/means to repatriate illegal residents in Judea and Samaria. The only difference is that now the process includes a judiciary review.

3. The decision to establish a judiciary committee to review the administrative process of repatriation was taken in response to the Israeli High Court of Justice (בג"ץ) decision that there should be judicial oversight.

4. Any illegal resident who stands to be repatriated will be brought before the judicial committee within 8 days of receiving the order, they will have the right to legal council, and will be able to appeal the judicial decision to the high court.

5. When making decisions about whether or not to repatriate an individual, the administrative and the judicial committees consider family ties.

6. Currently there are very few illegal Palestinian residents in Judea and Samaria - over the past several years, as a goodwill gesture to the Palestinian Authority, the Israeli government has approved an amnesty for nearly all of the 32,000 illegal residents whose names were submitted to the population registry by the Palestinian authorities.

7. Since the beginning of 2010, there have only been 5 Gazans who have been repatriated to Gaza.

8. The current system allows Israeli authorities to arrest, detain and deport illegal residents (specifically those who came in on a tourist visa and decided to stay) - these are the same powers that every sovereign nation in the world possess. The establishment of the Judicial Committee to oversee the process is the only change.

But the damage has been done and now the misinformation is being spread (by Haaretz) - as usual - all over the internetz... Journalists, please... give all the info and be sure that what you state is completely true (to your best knowledge).

Shi'a Wakf claims that Ezekiel's shrine is Muslim

In the week that Jews read the Biblical story of Ezekiel's valley of dry bones, there are resurgent fears that the Shi'a Wakf (religious endowment) wishes to turn the shrine of the Jewish Prophet Ezekiel into a mosque.

Two activists on behalf of the preservation of the shrine, at Kifl south of Baghdad, Mr Maurice Shohet from New York and Professor Shmuel Moreh, an Israeli emeritus professor of Iraqi origin, sent Point of No Return an article published on 2 April in the respected Arabic newspaper Al-Hayat in London and on the Sawt al-'Iraq site (The Voice of Iraq) in Baghdad. The article proves that the Islamic authorities consider that the tomb of the Jewish prophet Ezekiel is an exclusively Muslim shrine.

"That being the case, we find that we have to appeal to international authorities such as UNESCO, the US and European governments to redouble their efforts to save the Jewish character of Ezekiel's tomb," says Professor Moreh.

Religious authorities in Iraq are determined to convert the tomb of the Jewish prophet Ezekiel into a mosque after deleting Hebrew inscriptions, according to Al-Hayat and Sawt al-'Iraq. But a debate is still raging about the ownership of the shrine, and some Iraqis are prepared to stand up for Jewish interests.

The newspaper quotes the official in charge of the Shi'a Waqf (Endowment), Salih al-Haydari, who denies that the shrine belongs to the Jews. He says that the tomb is that of Dhu al-Kifl, a prophet mentioned in the Koran - proof enough that the site belongs to the Muslims. Recent excavations at the site, he claims, prove that it is not a Jewish site, although the findings have not yet been published!

The Shi'a Waqf in cooperation with the Ministry of Tourism and Antiquities is currently restoring the shrine. The foundations of the site have always been at risk from flooding and its minaret is in imminent danger of collapse.

However Mrs Mariam Omran, director of the Babylon heritage site, points out that Iraqi Jews used to visit Ezekiel's shrine up until their migration in the mid-20th century. "The removal of Hebrew writings and inscriptions is part of the process of erasing the memory of religious minorities who were the original inhabitants of Iraq and other parts of the Middle East," she says.

Mrs Omran says that the authorities responsible for preserving Iraq's ancient heritage have come under pressure from Islamists to remove Hebrew words and ornamentation, in readiness for the building of a mosque over the tomb of Ezekiel.

The article points out that the tomb was not previously of interest to Muslims until 2003, when the Shi'a Waqf started campaigning for the restoration of the site.

A spokesman for the Ministry of Tourism has denied reports that the character of the shrine is being altered. The tomb is being faithfully restored using original materials and old photographs, he claims.

The Department of Antiquities and Heritage has allocated about 250 million dinars for restoration work and maintenance, which began in the summer of 2008. A spokesman claims that the Muslim prophet Dhu al-Kifl is the same person as the Jewish prophet Ezekiel, who was taken prisoner by the Babylonian king Nebuchadnezzar in 589 BC.

The shrine dates back to the 14th century. The Ottoman period witnessed a struggle for control between Jews and Muslims. Most of the buildings and surrounding shops belong to Jewish families and rent is still being paid to the landlords in Israel and European countries.

A Gaza child "killed by Israel" miraculously comes to life

How propaganda forces disturb news articles. From Elderofziyon (commentary is his):

"From Ma'an, March 30:

A child was shot and killed east of the Yasser Arafat International Airport in Rafah on Tuesday, medics said.

Muawiya Hassanein, director of ambulance and emergency services in Gaza, said Muhammad Zen Ismail Al-Farmawi, 15, was shot dead near the southeasterly border by Israeli forces, while local sources who wished to remain anonymous said the death may have been an internal matter.

Hassanein said ambulances had been unable to retrieve the body because of ongoing clashes in the area, while an Israeli military spokesman said he had no knowledge of the incident.

DPA adds witnesses to those who claimed the boy was killed:

A 15-year-old Palestinian boy was killed Tuesday near the border area between the south-east Gaza Strip and Israel, witnesses and security sources said.

Witnesses said that Mohamed al-Farmawi, 15, of the southern Gaza Strip town of Rafah was shot dead by Israeli troops after he approached the fence along the border with Israel, which lies east of the town.

Gaza emergency chief Mo'aweya Hassanein told reporters in Gaza that medical teams and International Red Cross Committee (ICRC) coordinated with the Israeli army to collect the boy's body.

Multiple witnesses and Gaza officials all agree that the boy was killed and even that his body was recovered. You can't do better than that, can you?

Apparently, you can. From Ma'an today:

Palestinian teenager reportedly killed by Israeli forces has returned home alive and well, his family said Friday.

It turns out Al-Farmawi was among 17 Palestinians detained by Egyptian forces shortly after the infiltrated the Egyptian side of Rafah via one of Gaza's numerous underground smuggling tunnels. The detainees, among them 12 minors, were returned to security forces at the border on Friday.

Relatives expressed "overwhelming happiness" that their son was unharmed during the violence, our correspondent reported from Rafah.

Just more evidence that the veracity of Gaza "witnesses" and Hamas officials is approximately zero. Not that this will stop reporters and NGOs and UN fact-finding missions from believing them the next time they lie, and the time after that, and the time after that...."

The moral responsibility of a journalist

With the internet and news outlets growing and the increasing amount of journalists, the quality of news articles unfortunately deteriorates. If everyone can and is allowed to write, what else could one expect? Lies turn into truth. Dubious myths turn into facts. Reports from many organizations are believed without checking the facts. We live in an era wherein journalists copy others without checking facts, write illogical conclusions and spread lies, libels and other inaccuracies without being rebuked and wherein self-criticism is a word which does not exist in the dictionaries of most journalists.

And that while they are the ones informing us, citizens of the world. We have a right to be informed correctly. So we can make true judgments and will not be tempted to emotionally react on reported misinformation about a certain event

Therefore, more than ever I feel obliged to remind all journalists of the world the Declaration of Principles on the Conduct of Journalists - also known as the Code of Bordeaux:

IFJ Declaration of Principles on the Conduct of Journalists

"This international Declaration is proclaimed as a standard of professional conduct for journalists engaged in gathering, transmitting, disseminating and commenting on news and information in describing events.

1. Respect for truth and for the right of the public to truth is the first duty of the journalist.

2. In pursuance of this duty, the journalist shall at all times defend the principles of freedom in the honest collection and publication of news, and of the right of fair comment and criticism.

3. The journalist shall report only in accordance with facts of which he/she knows the origin. The journalist shall not suppress essential information or falsify documents.

4. The journalist shall use only fair methods to obtain news, photographs and documents.

5. The journalist shall do the utmost to rectify any published information which is found to be harmfully inaccurate.

6. The journalist shall observe professional secrecy regarding the source of information obtained in confidence.

7. The journalist shall be aware of the danger of discrimination being furthered by the media, and shall do the utmost to avoid facilitating such discrimination based on, among other things, race, sex, sexual orientation, language, religion, political or other opinions, and national or social origins.

8. The journalist shall regard as grave professional offences the following:
* plagiarism;
* malicious misrepresentation;
* calumny, slander, libel, unfounded accusations;
* acceptance of a bribe in any form in consideration of either publication or suppression.

Within the general law of each country the journalist shall recognise in professional matters the jurisdiction of colleagues only, to the exclusion of every kind of interference by governments or others."

Casualties of Truth

(This is the article that co-researcher "the Elder" wrote as an op-ed, that was inexplicably not published as planned. Much of it was beautifully rewritten by a prominent writer and author.)

For three weeks in December 2008-January 2009, Israel and Hamas fought a war in the Gaza Strip after Hamas announced it was abandoning the ceasefire and began escalated rocket and mortar attacks on Israel.

There is one fact about that war which people around the world think they know: there were about 1400 Palestinians killed in the war and most or almost all of them were civilians, mainly women an children.

This claim, however, is false and demonstrably so on the basis of careful research using publicly available and reliable materials. Indeed, a group of bloggers, including the author, have shown already that more than 30 percent of the claimed "civilian" casualties were in fact, to use the polite word, armed militants or members of Hamas-led security forces. And the number of such combatants we are discovering is rising every day.

While Hamas and other Palestinian political groups were using alleged civilian casualties to bolster their case with international public opinion, they demonstrably knew otherwise. In fact, they publicly bragged about the military activities of those they labeled innocent civilian bystanders.

The basis for many claims about the distribution of casualties was in a March report <http://pchrgaza.org/files/PressR/English/2008/list.pdf> by the Palestinian Center for Human Rights (PCHR). Widely covered‹and credulously accepted‹in the Western media, the report was a seemingly comprehensive, detailed list of every death. The bottom line: : the name, gender, age, location, and job of each person is detailed. Most importantly, the PCHR claimed 1180 of the alleged 1414 victims were civilians.

Our team cross-checked the names listed by PCHR with lists of "resisters" compiled by the Al- Mezan Center for Human Rights <http://www.mezan.org/en/index.php> , lists of "martyrs" published by Hamas, the Popular Resistance Committees (PRC), and other militant groups in Gaza, as well as from the Ma'an News Agency, and other Palestinian sources.

The IDF released its own report on casualties from Operation Cast Lead, saying that there were 1166 killed in Gaza, of whom 709 were known Hamas or Islamic Jihad militants. The IDF did not release their list of casualties, so we could not check specifics against the PCHR claims.

Our results so far show that at least, if all armed police are counted, 389 of the 1180 people who PCHR classifies as "civilians," were, in fact, militants.

PCHR's criteria to determine exactly who is a "militant" are unclear. Sometimes they speak of "active combatants" but at other times they state, accurately, that any members of armed groups, such as the Izz al-Din al-Qassam Brigades, would be considered legitimate targets under international law.

The team has identified members of Hamas, Islamic Jihad, the Popular Resistance Committees, the PFLP and the DFLP considered "civilians" by the PCHR. Examples include Adib Harb (brigade commander for the PRC), 'Eid 'Oda al-Shandi (field commander in the al-Qassam Brigades) and even senior Hamas leader Nizar Rayyan.

The IDF has categorized most or all of the Hamas police force as "Hamas or Islamic Jihad operatives" and therefore as legal targets. The PCHR takes strong exception <http://pchrgaza.ps/files/PressR/English/2008/44-2009.html> to this categorization, saying that Hamas policemen are civilians.

Even by the PCHR's own criteria, our research <http://elderofziyon.blogspot.com/2009/04/more-of-those-civilians-killed-in-gaza.html> has detailed proof identifying over 64% of the police killed in Operation Cast Lead ­ some 179 of them out of 283, were also members of militant groups, predominantly the al-Qassam Brigades acting as combatants against Israel.

Certainly, the PCHR is aware of the affiliations of many of not all of the victims in Gaza . For example, the PRC al-Nasser Salah Addin Brigades‹the most extremist group in Gaza which has been reportedly linked to al-Qaida--published a list <http://www.moqawmh.com/ara/index.php?act=News&id=2583> of its 18 of its "martyrs" on January 22. Yet nine of them, including two commanders, were classified as "civilian" by the PCHR months later. Similarly, an al-Qassam Brigades' leader famous for developing the Qassam rocket, Amir Yousef Al-Mansy, was also called a "civilian." It strains credulity to think that the PCHR was unaware that they were militants engaged in fighting Israel.

Why, then, did they classify so many known militants as civilians? One can only conclude that the reason is to deceive the media.

Such a high number of Al Qassam members among the police killed indicates that Hamas itself does not distinguish between its so-called civilian and military wings. Effectively, Hamas considers its police to be the same as its military force. If Hamas does not make such a distinction, why shouldn't everyone else conclude that its entire police force is a legitimate target?

In addition to the police, we have identified 115 other militants that the PCHR classified as "civilian." None of our findings are inconsistent with the IDF report on Gaza casualties.

While the PCHR misrepresents the facts about Palestinian casualties it makes other statements which reveal the highly politicized nature of the group that show it is not a human rights organization. For example, it consistently uses the phrase "IOF" ("Israel Occupation Forces") instead of Israel Defense Forces, the proper name of Israel's military, in trying to make Israel look as bad as possible.

The PCHR's influence cannot be overstated. UN groups routinely quote PCHR figures and reports. News media around the world rely on organizations like the PCHR to give them accurate information about what happens in Gaza. The PCHR presents itself as an unbiased party and is taken as such in media reports. The truth, however, is quite different.

Israel's war in Gaza was not aimed at causing civilian losses, nor was it a war of "occupation," as the PCHR would have it, but of defense. The fact that the casualty figures are being misrepresented is a demonstration of the fact that charges made against Israel are false. We are confident that as our research continues we will find many more soldiers of Hamas and other groups waging war against Israel disguised as civilians.
